Study Of Homestead Allocation System

In recent years,with the development of China’s economy and rural modernization,as well as the continuous improvement of various social security systems such as medical insurance,the protective function possessed by residential bases has weakened and their economic benefits have begun to gradually emerge.The home base allocation system that emerged in the era of planned economy is no longer fully compatible with the present social situation,and conflicts about the home base allocation system have emerged one after another.At the same time,because the system of home base allocation is relatively general in China’s legal regulations,it leads to different degrees of ambiguity in practice in terms of allocation subjects,allocation objects and allocation procedures.In this paper,we first study the legal regulation of the allocation of residential bases,starting from the principle of "one house per family" and "no compensation",and summarizing the legal history of the system of allocation of residential bases in China in conjunction with the procedure of allocation of residential bases and the subjects of acquisition,and pointing out the problems of the lack of legal regulation of this system in China,so as to pave the way for further research in the following paper.In the second part of the article,the study mainly focuses on the dilemma of the homestead allocation system in practice and the reasons why there is no land for homestead allocation in the present social context are analyzed.In this way,we can identify the problems and make suggestions for the improvement and reconstruction of the residential land allocation system as much as possible.This paper focuses on the problems of allocation subjects,allocation objects and allocation procedures of the residential land allocation system,and finally proposes countermeasures to solve the relevant problems,reconstructs the principles of residential land allocation.The paid use of residential bases is carried out according to the actual situation in different areas to ensure that farm households have a home.Through legislation and other means,we clarify the allocation subjects of the residential base allocation system,define clear allocation targets,simplify allocation procedures,and give more rights to residential base owners.
