Research On Electronic Evidence Authentication Of Civil Blockchain ——Taking Several Case As Analysis Samples

Blockchain electronic evidence is a new form of evidence manifestation arising from the combination of technology and justice.Thanks to its technical property of being untamperable or difficult to be tampered with,it can be applied in justice,which can ensure the real evidence,safeguard the authenticity and enhance the credibility.However,the fact is that the application of blockchain electronic evidence has not achieved a perfect ideal state,and there are still some problems,such as the questioning of the certificate storage platform,the lack of authentication rules,and the insufficient self certification of technology.To resolve this obstacle,it is necessary to build a set of review and certification system that meets the characteristics of blockchain electronic evidence.From the perspective of practice,this paper analyzes the judgment documents,summarizes the problems existing in the certification,and puts forward some suggestions for improvement.This paper is mainly divided into three parts,as follows:The first part mainly introduces blockchain electronic evidence and some basic theories of authentication.Firstly,it introduces the blockchain electronic evidence from the concept of blockchain electronic evidence,mainly about what characteristics it has compared with traditional electronic evidence and the evidence generation mode.Then the relevant contents of blockchain electronic evidence authentication are discussed,including the concept,content,characteristics and principles of authentication.Firstly,it starts from the general theory of evidence authentication,and then transitions to the relevant contents of blockchain electronic evidence authentication.The second part makes an empirical analysis on the authentication of current civil blockchain electronic evidence.Take a large number of judgment documents as samples for analysis,first analyze the standards and reasons of the collected samples,then make a macro analysis on the judicial application of civil blockchain electronic evidence,thirdly analyze the current situation of civil blockchain electronic evidence authentication,and finally analyze the problems existing in civil blockchain electronic evidence authentication from the current situation.The main problems are the lack of unified qualification standards for blockchain certificate storage platform,the lack of relevant certification rules,the lack of review of evidence before entering the chain,and the failure to give full play to the self certification power of blockchain electronic evidence.The third part puts forward its own ideas on improving blockchain electronic evidence authentication.Firstly,on the basis of developing a unified access qualification standard for blockchain deposition platform,a unified national judicial blockchain is promoted.Secondly,under the concept of perfecting rules and on the basis of existing authentication rules,suggestions are made to improve specific authentication rules.Finally,the self-certification power of blockchain electronic evidence is advocated to give full play to the self-certification power of blockchain electronic evidence in order to promote a more scientific and perfect judicial application of blockchain electronic evidence.
