| With the deepening of China’s ecological civilization construction and the increasing demand for the legalization of ecological civilization construction,cities divided into districts,as the main body of environmental governance at the local level,on the one hand,in the face of the rising requirements of the people for environmental quality,on the other hand,with the central government’s environmental protection legislative action in full swing in recent years,the legislative pressure on cities divided into districts is becoming more and more heavy.In 2015,the legislative law was revised for the first time,which made it clear that cities divided into districts have the right to formulate local regulations on environmental protection.Therefore,localized environmental governance has entered a new stage and the degree of rule of law has gradually improved.Local regulations on environmental protection have thus entered a "blowout" growth period.So far,there are more than 7000 effective local regulations on environmental protection,which are only listed on the relevant websites,and other local regulations with the nature of environmental protection,such as animal husbandry,fishery,forestry and energy,have not been included.Although some achievements have been made in local ecological environment protection and considerable improvement has been made in the ecological environment,the number of new environmental protection local laws and regulations issued every year is not so coordinated with the degree of environmental improvement.The reasons are mainly due to too much duplication of legislative content,weak legislative operability,insufficient public participation in the legislative process The positioning of the upper level law for local environmental protection affairs is not clear.In this regard,we should perfect the law,integrate the post legislative evaluation system,stimulate the enthusiasm and channels of public participation,and finally solve the above problems.On the one hand,the environmental legislation of cities divided into districts is a necessary measure to implement the superior law,and it is also the only way to open up the "last mile" of the legalization of environmental governance. |
