Active reconnaissance has a long history,and the combination of new communication,sensor and computing technologies has given active reconnaissance new means and connotations.From the perspective of electronic evidence,the third generation of electronic evidence,that is,data evidence,is being continuously improved and applied in judicial practice.Therefore,active investigation under new technical conditions focuses more on the collection of third-generation electronic evidence in the investigation activities.,through data collection combined with big data technology,it can provide strong support for predictive investigation.In the face of the new third-generation electronic evidence,the traditional retrospective investigation has become relatively weak,especially when it involves the need to collect online clues and evidence.In reality,the traditional retrospective investigation can capture data,there is also the risk of being tampered with and deleted.This requires the investigative agency to make more use of the advantages of technology and equipment to form a new investigation method on the basis of taking active investigation.This paper will re-examine active reconnaissance from the perspective of communication and sensor technology,and discuss the scope and methods of its detection.The master of sensor technology not only has a wide range of users,but also has various sensors that can be used for active investigation and collection of various information under new technical conditions.Combined with the continuous expansion of usage scenarios and penetration rates of smartphones The improvement makes smartphones more similar to personal electronic tags that can comprehensively collect information.At the same time,combined with specific data algorithms,it can even be calculated from mathematical models,so as to infer user behavior and trends,as a good medium for predictive investigation.Combined with the discussion on the affiliation of predictive investigation,it is concluded that in order to expand the benefit of the investigation and expand the sources of information in each link of the investigation,the active investigation under the new technical conditions can be carried out by relying on the use of smart phones.At the same time,this paper studies the legal issues involved in obtaining active investigation under new technical conditions and finds that although there are no lack of relevant legal provisions in the judicial system to support the development of active investigation under new technical conditions,the provisions are scattered.Moreover,a complete system has not been formed,and at the same time,it has caused a certain degree of intrusion on the privacy of smartphone users.Therefore,it is recommended to improve relevant laws and use new technical conditions in the investigation agency to regulate and supervise active investigation. |
