At present,China is accelerating the construction of social credit system.Public credit information,as a key part of the construction of social credit system,once there are errors and omissions in the process of collection,recording and sharing,it may weaken the social evaluation of the credit level of the evaluation object of public credit information.Therefore,a scientific and reasonable objection handling mechanism of public credit information is indispensable.At present,in the construction of public credit information system,because there is no social credit legislation in China,some pilot areas have formulated the management norms of public credit information according to the local reality,but they are still in the stage of exploration and innovation.The local system lacks scale basis in public credit information management.In addition,the dishonesty punishment system plays a role in credit supervision in many fields.The objection handling mechanism of public credit information needs to play a role in public credit information management with more scientific and perfect system norms.By sorting out the local public credit information management system,we can find that the system has problems in the relevant provisions of objection handling.First of all,it is not clear whether administrative organs,minors and foreigners can be the subject of objection application.In some places,there are multiple subjects accepting objections.Secondly,in terms of objection handling procedures,there are problems of fixed objection handling period,untimely objection marking,and the provisions on verification procedures are not comprehensive.Finally,in terms of the supervision of the objection handling process,there is a lack of special regulatory authorities and litigation filtering mechanism.Based on the mature experience of handling credit information objection in the credit investigation industry and abroad,and based on the principle of high efficiency and convenience,aiming at the problems in the current local public credit information objection handling system,this paper clearly includes administrative organs,natural persons over the age of 14 and foreigners into the scope of public credit information objection application subjects;Unified management subject as the subject of objection acceptance;The objection handling period of public credit information is subdivided into short-term settlement,deadline settlement and deferred settlement according to the complexity of objection matters;Once the objection information is accepted,it shall be marked with objection;Refine the handling of objection information by clarifying the verification process;By setting up professional information supervision departments and litigation filtering mechanisms,we can improve the supervision and management mechanism of public credit information objection handling,and strengthen the responsibility performance of administrative organs in the process of objection handling.The innovation of this paper is to refine the objection handling period of public credit information according to different situations.
