Abstract/Summary:
At present,corruption crimes are becoming more and more serious,showing obvious transnational and foreign-related nature,and corrupt officials usually use money laundering and cash smuggling to transfer corrupt assets abroad,resulting in the consequence that some or all of corrupt assets cannot be recovered through existing channels.As an important cooperation mechanism in international stolen goods recovery,the asset-sharing system can not only greatly stimulate the enthusiasm of the requested country to provide judicial assistance and increase the probability of success of international stolen goods recovery,but also fundamentally prevent and combat transnational crimes such as corruption crimes.Therefore,it is of great significance to improve and refine China’s asset-sharing system.This paper adopts the literature method and the comparative research method,based on the development status of China’s asset-sharing system,and focuses on the problems of imperfect relevant legislation,lack of corresponding supporting measures and lack of bilateral agreements on asset-sharing.A horizontal comparison of the construction of asset-sharing systems in European and American countries,and then through the improvement of the relevant contents of the asset-sharing system involved in China’s International Judicial Assistance Law and the Criminal Law,the improvement of relevant supporting measures,and the use of bilateral agreements and taking into account case-by-case cooperation,to establish a perfect asset-sharing system that is sufficient to cope with the problems of asset recovery encountered in international stolen goods recovery.
