| With the popularization and development of Internet technology,network technology has been gradually applied in charity activities,which has promoted the diversified development of charity.Internet users,charitable organizations and Internet platforms,as the main bodies involved in online charity,jointly promote the development of online charity.With the development of online charity,the legal relationship between various subjects is becoming more and more complex,and even events such as "fraud" or "fraudulent donation" appear.It is urgent to regulate online charity.Starting with the basic concept of online charity,this paper analyzes that compared with traditional charity,online charity has the characteristics of universal,virtual and efficient.The legal basis and practical significance of online charity lies in the basic human rights,including the right to survival,the right to material assistance and social rights,as well as the state’s obligation to fulfill social assistance and improve the social assistance system.The development of network charity promotes the third distribution and realizes the value of social fairness and order.In the process of the development of online charity,a series of problems have emerged: first,the relevant legislation on online charity is insufficient,and the existing laws and regulations on a series of behaviors produced in charitable activities are not perfect;Second,the law enforcement related to online charity is insufficient,and the law enforcement efforts of relevant departments for charity activities are lack of flexibility and supervision;Third,the supervision system of online charity is not perfect,and the effective supervision system of online charity by Internet users,news media industry,third-party evaluation institutions and other subjects is not perfect;Fourth,the credibility of the internal entities of online charity activities is insufficient,and the credibility of the helpers,charitable organizations and online charity platforms participating in charity activities is insufficient.In view of the above problems,we should use legal means to regulate online charity activities.The specific measures include: first,improve the relevant legislation of online charity,modify and supplement the law in time,or make judicial interpretation of the existing legal provisions in the judicial process;Second,improve the law enforcement of online charity,regulate the law enforcement efforts of various departments in the process of law enforcement of charity activities,and increase the number of law enforcement personnel to enhance the law enforcement force;Third,improve the online charity supervision system,and build an online charity supervision system including government supervision,public supervision and third-party evaluation;Fourth,improve the credibility of various subjects within online charity activities,ensure that the progress of charity projects at all stages is open and transparent,and the information of charity projects is true and reliable. |
