Research On Mobile Pledge Of Movable Property

As a new way of guarantee,movable property pledge originates from the market economy and reflects the real-time demand of the market.But it also raises new problems because the current system is not perfect for this aspect of protection.In jurisprudence,there are grave differences in the explanation of the nature and validity of dynamic pledge,and the disputable issues related to movable property pledge are also accompanied by many problems to be solved,such as different judgments,disparate regulars of quotation by the court.This type of genuine condition may harm the lawful rights and Parteiinteressen concerned and may also give rise to the predicament of moving pledge of movable property in the direction of financing for small and medium-sized enterprises.After sorting out,the author finds that most of the current researches on movable property pledge stay in the financial field,starting from logistics and banking.However,it is not enough to discuss and study movable property pledge from the perspective of law.Therefore,this paper tries to sort out and elaborate the related issues of movable property pledge through the combination of cases and theories.This paper mainly analyzes the movable movable pledge system from three perspectives.Firstly,starting with the basic idea of movable movable pledge,it expounds its concept,advantages and types,and distinguishes movable movable pledge from other rights.Secondly,through the analysis of the establishment of the pledge right in movable movable pledge,it points out some problems and phenomena existing in the previous practice,in order to provide new ideas for the later legislation,and also points out the conditions that the establishment of movable movable pledge should have.Finally,through the analysis of the pledge supervision of movables pledge system,mainly through the analysis of the nature of the supervision agreement and the obligations and responsibilities of the supervisor,various theories in practice are sorted out to form their own views.Theoretical research on movable property pledge system is the main way to balance the relationship between enterprise rights and free development,try to reduce the negative impact,provide solutions to the issues,make logical direction or decision,and then take action on the market-oriented economy.Thus promoting the sound development of social economy...
