In recent years,with the rapid development of science and technology and the Internet,UAV technology has developed by leaps and bounds,from fuselage structure design to flight control technology,from remote sensing technology to UAV communication technology and obstacle avoidance technology,compared with a few years ago,it is no longer the same.Now in the era of big data,the 5G field is in full bloom,large and small base stations will be built in the country,and the UAV industry will benefit from the progress of communication technology and will usher in more rapid development.The number of drones produced continues to increase and the number of people’s ownership is increasing,and drones have begun to show their skills in various fields,from aerial photography to mapping,from agricultural plant protection to case investigation,we can see drones everywhere.Drones shine in the civilian field,on the one hand,to facilitate our production and life,on the other hand,but also to erode people’s rights.In daily life,the phenomenon of manipulators using drones to infringe on the privacy rights of others is becoming more and more frequent,and they use ultra-high-definition cameras and sensors carried by the drone fuselage to arbitrarily collect other people’s private information,and disclose and use these private information,disrupting the daily production and life of citizens and violating the legitimate rights of others.Not only that,under the threat of drones,private information is more accessible,and when this private information is leaked,it will trigger more serious consequences than traditional infringement.In the current situation,how to not only protect citizens’ privacy rights by law from being violated by civilian drones,but also continue to maintain the current development momentum of the drone industry is a problem we must face.This article starts from the case of the invasion of privacy by drones in recent years,introduces the concept of civil drones,emphasizes the distinction between civil drones and national drones,on this basis,introduces the difference between civil drones infringing on privacy and traditional ways of violating privacy,and then sorts out the current laws of Our country in the field of drones,and draws the shortcomings of the current Chinese laws in the supervision of the invasion of privacy by drones,and learns and references the legislative experience outside the region.Finally,it is proposed to promote systematic legislation in the field of civil unmanned aerial vehicles,implement the "Flight Management Regulations" as soon as possible,and in view of the particularity of the infringement of privacy by civil unmanned aerial vehicles,the responsibility for the infringement of privacy rights by civilian UAVs is clarified in the "Flight Management Regulations",so that some legislation and current legislation jointly form a normative system for protecting citizens’ privacy rights,protecting citizens’ privacy rights while ensuring the sustainable development of the civil drone industry. |
