Study On The Legal Protection Of The Rights And Interests Of Ecological Immigrants

As we pay more and more attention to the protection of the ecological environment,the ecological migration project has become a hot topic in the society.However,from a practical point of view,there is a certain gap between the ecological migration and the expected effect,especially the rights and interests of the ecological migration still suffer different degrees of damage,so the protection of the rights and interests of the ecological migration must be further improved,only in this way can we lay a good foundation for the smooth advance of the ecological resettlement project.Therefore,through the methods of Literature Study and Comparative Study,this paper takes the protection of the rights and interests of ecological immigrants as its theme,it is divided into four parts: the introduction,the definition of the rights and interests of ecological immigrants,the problems existing in the protection of the rights and interests of ecological immigrants,and the suggestions to improve the legal protection of the rights and interests of ecological immigrants,the paper focuses on finding out the big problems in the protection of the rights and interests of ecological migrants and gives some suggestions to improve the protection of ecological migrants.In the introduction part,the background,significance,domestic and foreign research status,domestic and foreign legislation status and research methods are simply described.In the second part,the definition of ecological migration is expounded,that is,large-scale population migration is carried out under the guidance of the government with the aim of restoring the ecological environment of the moving place and protecting and improving the ecological environment of the large region.Then it defines the rights and interests of ecological immigrants,distinguishes the rights and interests of immigrants and ordinary citizens,and classifies the special rights and interests of immigrants.The third part mainly analyzes the problems existing in the current practice of protecting the rights and interests of ecological migrants,and finds that the current problems mainly lie in four aspects: Legal System,security system,property compensation system and implementation supervision,the specific problems include the lack of specific laws,citizen participation system,imperfect appeal system,lack of social compensation,weak supervision and so on.The fourth part is based on the third part of the problems of the perfection of the proposal,the legal system to supplement the specific legislation,improve the system structure of the proposal;In the safeguard system,it is proposed to perfect the immigration participation system and the immigration appeal system,including strengthening the information disclosure,clarifying the stages and ways of the immigration participation right,and improving the immigration participation ability In the aspect of compensation system,three suggestions are put forward,including administrative,social and retrograde compensation,and the hearing system should be established at the same time.The conclusion part,the author once again elaborated the article mentality and the main point of view.
