| The arrival of THE 5G era makes the market for live sports events more robust and generates a large number of sports IP.On the one hand,it meets the audience’s demand for watching sports events.On the other hand,it brings great benefits to live sports event platforms and drives economic benefits.However,the endless phenomenon of network piracy and the lag of legal protection have hindered the healthy and orderly development of sports industry.The phenomenon of piracy and infringement of live sports programs occurs frequently,and the problems caused by it need to be solved urgently.In view of this,this paper conducts all-round analysis and research on the above infringement phenomena and legal issues,improves the copyright protection system of live sports events,and creates a clean and upright environment for live sports network broadcasting.In addition to the introduction and conclusion,the paper mainly includes the following four parts:The first part begins with an overview of live sports events.On the one hand,taking the definition of live sports events as the starting point,the paper integrates the confusing definitions of current sports events,pictures of sports games and transmission signals of sports games,so as to clarify the research object more clearly.On the other hand,the perfection of law application and judicial practice is further explored through in-depth study of the legislation and judicial protection of the copyright of sports games rebroadcast TV programs.The second part focuses on the legal attributes of live sports events.First of all,through the analysis of the composition of the work,it is clear that the key to the legal attributes of live sports events is the evaluation criteria of originality.Secondly,by comparing the originality standards of the two legal systems and combining the legislative origin,legislative model and judicial experience of China’s copyright law,the author puts forward that China must adhere to the minimum standards in the recognition of works.Finally,it studies the identification factors of originality of live sports event programs,which should belong to the works stipulated by copyright law and the type of works should be audio-visual works.The third part divides the ownership of the right of live broadcast of sports events.Sports live TV manufacture process and procedure is numerous,involving different interest subjects,but the present copyright law rights belonging to its definition is very cumbersome and not clear,so you need to the parties involved in the production link related subject and has clear ownership rights,so if have any infringement occurs,the parties to the main body of the appeal to be able to tend to.The fourth part is mainly about the copyright protection of live broadcast of sports events.First of all,it is necessary to establish a perfect right protection system and clearly regulate the right structure involved in live sports events through copyright law.Second for "connection with different sentence" phenomenon in the judicial practice may require the supreme law issued judicial cases related issues shall be clear and also can through legal interpretation methods to make up for the loopholes in the current legislation,finally,the live sports events market operation mechanism is also put forward the feasible measures for the administration,autonomous management system of the building industry,Let the major broadcasters,operators to perform certain social responsibilities,in order to better help the rights of the main body to safeguard legitimate rights and interests. |
