Research On The Problems And Resolutions Of The Duty Lawyer System In China’s Judicial Practice

On November 16-17,2020,President Xi Jinping delivered an important speech at the Central Work Conference on the Comprehensive Rule of Law,and once again emphasized the important role of the comprehensive rule of law in the future development of China.To implement the tasks and work in the process of comprehensive rule of law,on the one hand,we need to build a more complete and sound legal system to fill the blank areas where the law should be involved;on the other hand,we need to build a more perfect and scientific legal system to match it,so that the law can play its proper role.Along with the increasing development of China’s economy,the process of guaranteeing the rule of law and human rights in China has never stopped.The duty lawyer system is one of the many legal systems in China,and its establishment is an important symbol of China’s judicial system reform.It not only enriches the legal system of China but also promotes the deepening of the process of rule of law in China.However,due to the late start and development of the system in China compared with the western countries,there are many specific aspects in practice that need to be combined and adapted with the basic national conditions of China.Therefore,it can be said that although the duty lawyer system has been established in China,its role still has a large space for improvement.Based on this,this paper has explored the problems of the duty lawyer system in the judicial practice in China.The aim is to put forward targeted countermeasures,so that it can further adapt to the process of China’s socialist rule of law modernization,in line with the work of the comprehensive rule of law,and then for the completion of the overall goal of the socialist rule of law country to play its due effect.
