Research On The Legislative Change Of Ethnic Regional Autonomy

The right of legislative change in ethnic autonomous areas is a power that the ethnic autonomous areas stipulated in the Constitution and related laws can make legislative adaptations to certain specific legal provisions on the basis of comprehensive consideration of regional political,economic,and cultural specificities.For ethnic autonomous areas,the legislative adaptation power is a special power conferred by the constitution.The granting of this power provides an important means of support for ethnic regions to achieve autonomy.There are many different viewpoints on the study of the legislative power in the ethnic autonomous region in the current academic circles,and various viewpoints are in conflict with each other.At the same time,from the perspective of specific practices,there are also many problems in the application of legislative powers in ethnic autonomous areas.It imposes greater restrictions on the full play of its own effectiveness.The research of the dissertation firstly introduces the background and significance of the study,and summarizes the significance of the legislative power of ethnic regional autonomy from the perspective of jurisprudence.Then,based on relevant data,the author analyzes the historical evolution of legislation in China’s ethnic autonomous regions and puts forward three phases of the development of the legislative power in the ethnic autonomous regions of China.On this basis,by analyzing the specific implementation content of the legislative mutatis mutandis in ethnic regional autonomous areas in China,this paper analyzes the problems in the four aspects of the legislative competence,the legislative work-around procedure,the scope of power exercise,and the construction of the legislative team in the regional ethnic autonomous areas..Finally,corresponding strategies are proposed for these four aspects.From the perspective of jurisprudence,the research of the dissertation further defines the concept and connotation of the legislative power of ethnic autonomous regional autonomy,and at the same time clarifies the legal value of the legislative alternative power in ethnic autonomous areas.The paper analyzes the issue of the legislative rights of ethnic regional autonomy and proposes targeted strategies through four perspectives: legislative authority,legislative alternative procedure,legislative legislative exercise scope,and legislative team construction,so as to better satisfy the characteristics of multi-ethnic coexistence in China.It has important practical significance for promoting the harmonious development of all ethnic groups,and it also has important theoretical significance for the improvement of relevant laws and regulations.
