| In judicial practice,cases of mental patients causing accidents often occur,and some mental patients even cause accidents for many times,which has caused great losses to both parties and their families and seriously affected the stability of the society.Considering that the management of this special group is still relatively weak,how to strengthen the protection and control has long been the focus of judicial practice.Taking it as a starting point,the compulsory medical treatment system for mental patients extended in judicial practice has become a necessary measure to maintain social order.The amendment of the Criminal Procedure Law greatly promoted the function of the system,and the formulation of a series of supporting detailed rules by various political and legal units further promoted the detailed implementation of compulsory medical treatment.Through the development of these powerful practices,it has laid a solid institutional foundation for the protection of the legitimate rights and interests of mental patients and the maintenance of social order and stability by relying on the function of the system.However,with the continuous deepening of practice,the compulsory medical system has also exposed some problems that need to be improved.Paper through analysis of current mental patient compulsory medical treatment system,carding summed up the problems existing in the current judicial practice in our country,on this basis,combining with practice,and learn from outside the judicial practice experience,the comparison and analysis the sublation on the basis of the proposed solution,for the system to improve constantly,make the practice effect and corresponds to the theoretical basis,Moreover,it can effectively connect with supporting judicial appraisal,public opinion control and grass-roots social governance.At the same time,there are differences in the understanding and application of the system among countries in the world,which further extends the design of the system with its own characteristics.Therefore,we should broaden our vision based on the reality of our country,and apply some successful experiences from other countries to the improvement of China’s compulsory medical system.Through the use of a variety of comprehensive measures,to promote the effective operation of the compulsory medical system. |
