Research On Telecommunications Fraud Crime

Telecommunication fraud crime is a new kind of fraud crime phenomenon under the background of modern society.This criminal phenomenon can be traced back to the message fraud in the early 21 st century,later than that,We Chat,QQ,telephone fraud and other various but similar fraud methods emerged.Criminals invent traps by using different decoy factors such as power,emotion and money,and send information to non-specific potential targets in a large range through technical means,and make them receive the corresponding information and transfer the money to criminals in a non-face-to-face way.The term telecommunication fraud was coined and popularized.Over the years,numerous victims of telecom fraud crime by the harm,lost income,or even sudden death or suicide.At present,the research from all angles to the telecom fraud crime causes and countermeasures are elaborated,formed a variety of reasons and countermeasures,but these studies mostly focus on the reasons and countermeasures analysis,lack of system.At present,study on the telecommunication fraud crime phenomenon,especially the concept research is insufficient.From the point of view,there is a lack of application and explanation of criminological theory.Therefore,this paper expounds the definition and understanding of telecom fraud crime through the conclusion and summary of the case,and explains the phenomenon of telecom fraud crime by using social learning theory through the characteristics presented by the case of Guangdong province,and finally puts forward some prevention suggestions.There are four parts altogether.The first part is the definition about telecommunication fraud and its type.Based on those points of scholars,I made some new understanding about the definition of telecom fraud crime,and according to different factors bait,the telecom fraud crime can be divided into five categories,such as power factor,social policy,social relations,material temptation and daily needs.The second part is mainly about the characteristics of telecom fraud crime.By analyzing the case of judgment documents in Guangdong province,there are some findings about the fraud offenders,criminal behavior,victims and penalty characteristics.The perpetrators of telecom fraud in Guangdong province are mainly young males,mostly from D District of Guangdong province.Most of them are young people with low education background,and also they have a strong desire for money.From the point of criminal behavior,the telecom fraud crime groups have more learning behaviors,and at the same time,the criminal acquisition channels are rich.In the type of behavior,social relations type of fraud more.The third part is reason analyzing.Based on the social learning theory,more and more telecommunication fraud crime behavior can be explained.Social learning theory emphasizes the interactive relationship the between environment and individual behave.It includes behavior acquisition mechanism,behavior arousal mechanism and behavior control mechanism.The theory can be used to explain both good behavior and bad behavior,even criminal behavior.For the telecom fraud crime,the main ways to obtain criminal behavior are criminal subculture,bad friends relationship and the enhancement of the media symbol ability;Criminal behavior is mainly aroused by feelings of depression,alienation and deprivation;The maintenance of criminal behavior is mainly realized through the enhancement of the effect of external light punishment,the substitution and reinforcement of others’ behavior and self-enhancement.The fourth part is about prevention on telecom fraud crime.Based on the analysis of the third part,the prevention can be carried out from three aspects:purifying the obtaining ways,increasing individual opportunities and reinforcement of hindering behavior to reduce their criminal benefits.The ways to purify include the governance of criminal areas,strengthening the management of floating population and the construction of media reflection;The purpose of increasing individual opportunities is to improve their social capital.The government provides opportunities and informal organizations promote the realization of opportunities.In the long run,schools can set up vocational education courses in various stages to guide students at different stages to establish a good outlook on career and life.
