| The system of administrator is an important legal system to collect,liquidate and distribute the property left by the deceased.Since January 1st,2021,China’s Civil Code has been promulgated and implemented,and this system is specifically and meticulously explained in Chapter IV of Part VI.Based on the relevant contents of the Civil Code,this paper will analyze and evaluate the legislation of this system,and point out the shortcomings and corresponding suggestions.The system of the administrator of the estate was created by our country at the present stage,which is the development and progress of the inheritance activities and increases the operability of the estate distribution activities.At present,as far as the present situation of China’s social development is concerned,it has always been the hope of scholars and experts to formulate a system that suits the current social and economic trend of China.The establishment of this system can solve all kinds of disputes caused by heritage more quickly and protect the legitimate rights and interests of all parties.This system will be discussed in this paper.According to the current applicable legal norms in China,and based on the relevant provisions of the Civil Code,this system will be deeply and concretely discussed in order to make it more complete.The first chapter of this paper discusses the system as a whole.Through the statistical analysis of related cases,problems are found from specific cases,and related concepts are discriminated,and the functions of the system are elaborated in detail.The second chapter is to express the legislative status of this system in China,judge it,and analyze its value and shortcomings.The third chapter expounds the situation of this system in other countries or regions,and combs and summarizes its enlightenment to China according to its mature experience.The content of the fourth chapter is to put forward some suggestions to improve the system,try to make it more in line with China’s development status,and make the inheritance procedure go smoothly,so as to promote family harmony and maintain social stability. |
