Research On Legislation Technology Of Laws And Regulations Of CPC

As an integral part of the socialist rule of law system with Chinese characteristics,laws and regulations of CPC have entered a period of rapid development after the 18 th National Congress of the Communist Party of China.To formulate laws and regulations of CPC with complete content,rigorous logic,and effective operation,it is necessary to pay attention to the formulation technology of laws and regulations of CPC,and to ensure the quality of laws and regulations of CPC from a technical level.Through the literature research method,the comparative research method and the case research method,this article first sorts out the legislation techniques issues of the laws and regulations of CPC,and believes that there is the clarity of the formulation subject and authority,the planning and planning coordination,and the rigor of drafting and review in the formulation process.There is still room for further improvement.At the same time,in terms of structural technology and language technology,there is the possibility of further improvement of the uniformity of the formal structure,the rigor of liability clauses,and the standardization of language expression.Secondly,laws and regulations of CPC and national legislation are both creative norms,and the socialist legal system with Chinese characteristics has been formed in2010.The national legislation has relatively complete legislative procedures and mature expression techniques,which can be used as a reference for the formulation of laws and regulations of CPC.Therefore,study the connection and difference between the two formulations,and consider the similarities of the two values,the constitution as the fundamental compliance,etc.;there are differences in the logic of the provisions,the complexity of the formulation procedures,and so on.So as to provide a basis for the feasibility and limits of the laws and regulations of CPC to learn from the national legislative technology.Finally,in view of the problems in laws and regulations of CPC formulation technology,the formulation process proposed to strengthen the planning and plan top-level design,refine the drafting process,and strictly review and approve the mechanism;to improve the formal structure and enhance the responsibility clauses for the structure and language technology.Suggestions on the rigor of structural logic and improving the accuracy of language expression.Provide a technical path to promote more standardized formulation of laws and regulations of CPC.
