Perfection Of The Incidental Examination System Of Administrative Normative Documents

The current Administrative Litigation Law clearly stipulates a system of incidental review of normative documents.When a party files an administrative lawsuit against an administrative act,he may apply to the court for an incidental review of the normative document on which the administrative act is based.Under the background of "building a government under the rule of law and carrying out administration according to law",the introduction of a review system attached to normative documents is undoubtedly more conducive to protecting the legitimate rights and interests of the parties,and is also conducive to ensuring judicial justice and administration according to law.Based on the above background,this paper deeply analyzes the problems existing in the review system attached to the normative documents:the initiation of the attached review has limitations,the scope of the attached review is limited.Restrictions,unclear content of incidental review,imperfect review procedures,and insufficient rigidity of review results.After an in-depth analysis of these problems,it puts forward suggestions for improving the review system attached to administrative normative documents in my country.In order to prevent the occurrence of disordered phenomenon in which the administrative acts caused by irregular normative documents hinder the legitimate rights and interests.
