Study On Coordination Of Regional And Multilateral Mechanisms For International Trade Dispute Settlement

The establishment of the World Trade Organization has greatly promoted the development of the systematization of international trade law,which not only keeps the world market economic order stable,but also greatly promotes the development of trade rules.However,since the 1990s,against the backdrop of various difficulties in multilateral economic cooperation,countries and regions in the world have turned their attention to regional trade cooperation,and various forms of regional trade cooperation have emerged continuously.Therefore,the rapid growth of regional cooperation has brought a great shock to the WTO multilateral system and opened the academic discussion on whether regional trade cooperation and the world multilateral trade system can coexist harmoniously.This paper tries to find a win-win coordination way between regional economic cooperation and multilateral trade system,accelerate the process of global economic integration and trade liberalization,and help global trade liberalization find a more effective reform path in the process of realizing its goals.Starting from the second chapter,this paper expounds the provisions of article 24 of WTO agreement on regional trade agreements,analyzes some defects in it,and then discusses the conflicts between the regional trade dispute settlement mechanism and the multilateral mechanism of WTO.In addition,four typical cases,namely the European Union,the North American Free Trade Agreement,the UNITED States-Mexico-Canada Agreement and the China-asean Comprehensive Economic Cooperation Framework Agreement,are selected to discuss the respective situations and causes of jurisdictional conflicts,as well as the possible adverse results.The third chapter analyzes and puts forward that the internal conflict between regionalism and multilateralism is the theoretical root of the conflict between regional and multilateral mechanism in international trade dispute settlement.The fourth chapter of this article in view of the regional and multilateral trade disputes settlement mechanism of coordination make corresponding theoretical construct,the fifth chapter focuses on the reality in the mechanism of dispute settlement mechanism of the regional and global multilateral coordination practice countermeasure,proposed to establish the global multilateral coordination mechanism should adopt the reasonable path,that is put forward based on the multilateralism and construct regional tentative Suggestions.Finally,combined with the foregoing elaboration,make a summary.
