Research On Characteristics Of Patent Litigation Of Mobile Communication Enterprises

Recently,mobile communication industry has developed rapidly all over the world and the technological competition among mobile communication enterprises has become increasingly fierce.More and more mobile communication enterprises have valued the development and application of patents,which has led to patent competition among peer companies through patent litigation is becoming more and more intensified.The intersection and high similar of patented technology have made the complexity of patent litigation among mobile communication companies.What’s more,the Non-Practicing Entity（NPE）frequently sues mobile communication enterprises,resulting in a high volume of patent litigation cases.Therefore,more and more mobile communication enterprises have gradually involved in patent litigation.Patent litigation of mobile communication companies is becoming more and more serious so exploring the characteristics of patent litigation of mobile communication companies has great theoretical value and practical significance for obtaining the development trend of industrial litigation and improving the ability of patent litigation management of enterprises.Exploring the characteristics of patent litigation among mobile communication enterprises from litigants and litigated patents.Firstly,analyzing evolution of patent litigation networks in mobile communication industry by Social Network Analysis（SNA）and obtaining evolution and trend of industrial patent litigation and then identifying four types of core companies.Secondly,researching the characteristics of patent litigation activities among mobile communication enterprises and finding out common features and personality characteristics of patent litigation acativites among different types of mobile communication companies.Thirdly,analyzing the characteristics of patent value both patents have been sued repeatedly and patents have been sued only once based on configurations by Fuzzy Set Qualitative Comparative Analysis（fs QCA）.At last,based on the findings proposing suggestions about improving the ability of patent litigation management to different types of mobile communication enterprises.The research findings are as follows.First,it shows that after experiencing abnormal growth,patent litigation gradually tended to be normal,which is closely related to the change of American patent system and the abilities of suing and defense of enterprises has improved.The proportion of NPEs in the patent litigation network has been more than mobile communications enterprises and NPEs have focused on suing some mobile communications entities rather than numerous litigants and the number of targets is decreasing but the frequency of litigation is increasing.Second,the litigants are divided into 4 types: Defensive Enterprises,Aggressive Enterprises,Observers and Enterprises Being Attacked and it is different from suing and being sued.It is common that being sued and the decline of patent litigation is generally low among mobile communication enterprises.What’s more,most litigants are dominated by one-way litigation and frequent litigation occurs only among several peer companies.Third,the litigated patents present multi-dimensional value characteristics and there are several configurations regarding litigated patents that has been sued repeatedly and several configurations considering litigated patents that has been sued only once.A patent that has been sued multiple times are more value than a patent that has been sued only once.The litigated patents of different types enterprises also showThe study could provide theoretical basis and scientific guidance for mobile communication enterprises to improve their patent litigation management capabilities.It helps companies s improve their ability to prevent and respond to patent litigation risks.
