Research On The Full Coverage Of Lawyer’s Defense In Criminal Cases In J City Of H Province

Criminal defense exists in the whole process of criminal litigation,and in recent years,the system of full coverage of defense by lawyers in criminal cases has been rolled out on a comprehensive pilot basis,so that the prosecuted person in criminal cases can obtain the "most basic protection of rights".The introduction of the Opinions on Improving the Legal Aid System,the Opinions on Carrying Out the Work of Legal Aid Duty Lawyers,and the Measures on Launching the Pilot Project of Full Coverage of Lawyer’s Defense in Criminal Cases,which has comprehensively improved the rate of lawyer’s defense in criminal cases,promoted the reform of the trial-centered litigation system,challenged the traditional concept of criminal justice,and better safeguarded the legal rights and interests of criminal suspects and defendants.The lawful rights and interests of criminal suspects and defendants are better protected.At the same time,there have been many discussions and new challenges that need to be addressed.The pilot time of the full-coverage defense system of lawyers in criminal cases in J city,there are problems such as the low quality of assistance defense,the limited function of assistance lawyers and duty lawyers,and the failure to keep up with the supporting measures of the full-coverage pilot.The article has three main parts except for the introduction.In the first part,the basic concept,theoretical basis of value and significance of the implementation of the full-coverage system of defense by lawyers in criminal cases are explained,and the second part summarizes the effectiveness of the pilot project in the pilot area,J city,H province,and points out the advantages of the pilot project.The third part combines the pilot practice of the pilot area H province J city,through research visits to assistance lawyers and judges and prosecutors,and research on samples from the criminal assistance defense cases after the pilot,to analyze the problems of the quality of assistance lawyers’ defense,the system design of full coverage about assistance lawyers’ defense and legal assistance provided by duty lawyers,and the supporting measures of full coverage in the work of full coverage of assistance lawyers’ defense.The fourth part starts from the problems and proposes that to promote the system of full coverage of defense by lawyers in criminal cases,it is necessary to improve the quality of defense by assistance lawyers,the science of system design,and the construction of relevant supporting systems.
