Research On Related Issues Of Medical Dispute Litigation Cases In Shandong Province From 2017 To 2019

Empirical research should collect and use a large number of data to induce problems and clarify views.From 2017 to 2019,the judgments of civil cases in Shandong Province were collected from the People’s Court,involving 2,356 medical disputes.First of all,theoretical analysis,medical disputes,medical litigation,medical tort liability,medical damage identification system and expert system and other basic concepts and systems.Secondly,by analyzing the trial procedure of Medical Dispute Litigation,the changing trend of quantity,the situation of technical appraisal of medical dispute,the application of the expert assistant system,and the appearance of the expert appraiser,the data of related problems are obtained respectively,these data are reflected and analyzed from different angles through three-line chart and polyline chart.The main advantages of using litigation to settle medical disputes are: The effective judgment of the People’s Court has res Judicata,the payment obligation of the OBLIGOR can be fulfilled in time,etc..The main problems in medical dispute litigation are: The high rate of appeal is caused by disputes over the authenticity of expert opinions,the absence of expert witnesses,the absence of cross-examination of expert opinions,etc.Under the "dual system" appraisal model,the doctor and patient either choose the Applicable Medical Association to carry out the medical error technical appraisal or choose the judicial appraisal institution to carry out the judicial appraisal,it leads to disputes on the conclusion of expert testimony or leads to re-appraisal,the application of expert AIDS is few,the litigation cycle is too long,etc..Finally,in view of the question and the reason analysis puts forward the consummation medical lawsuit the proposal,mainly includes: consummates the medical damage appraisal mechanism,breaks down "the dual system" the pattern barrier,consummates the appraiser to appear in court system,play the role of experts to assist people,improve procedures to avoid the extension of the litigation cycle,improve the medical dispute people’s mediation procedures and trial procedures,and so on.Figure 1;Table 6;Reference 57...
