On The Authenticity Of Image Electronic Evidence And Its Review

At present,the research on the authenticity of evidence in our country mainly focuses on the form of truth,and the study of substantive truth is rare,however,substantive truth is an important guarantee to achieve the role of proof of evidence.Image electronic evidence is stored in the form of data in the information system,electronic image as the form of evidence material,with equipment dependence,imaging effect uncertainty and poor stability and other characteristics.Its authenticity by the forensic technology standards,imaging equipment and display equipment and the impact of the operating environment,such as by the image processing its authenticity is also affected by the image processing technicians and image processing technology methods.At present,the authenticity of the image electronic evidence review on the one hand is mainly limited to the formal authenticity and substantive authenticity is often missing,on the other hand,its formal authenticity review is also incomplete,authenticity review in the existence of review standards are not clear and review method single problem.The study concluded that the authenticity review should be further improved according to the characteristics of this type of evidence.It is recommended to refine the review criteria,increase the review method and expand the review content;develop operable authenticity review standards,multi-angle,multi-latitude authenticity review,not only need to review the qualification of forensic and processing subjects,forensic procedures and processing procedures,forensic technical standards and the original evidence and other formal authenticity content,but also need to review the technical methods of image processing,electronic image expression content and other substantive authenticity content.
