Research On Legal Issues Of Urban Traffic Congestion Control Under The Background Of Intelligent Transportation

Traffic congestion is an unavoidable problem in the process of urban development.After the introduction of intelligent transportation technology,the urban traffic legal system to deal with traffic congestion should also be changed.It is of great theoretical and practical significance to deeply understand the requirements of the times and explore the basic ideas and rules of legal perfection.Firstly,this paper defines the concepts of urban traffic congestion and intelligent transportation,analyzes the causes of urban traffic congestion in China by combining the theory of traffic supply side structural reform and traffic demand management,and seeks the governance methods of urban traffic congestion under the background of intelligent transportation from the perspective of regulating the relationship between urban traffic supply and demand,On this basis,we can understand the practical legal needs of urban traffic congestion management in China.Secondly,it combs the practical problems and main legal problems of urban traffic congestion management in China,and points out that in terms of intelligent transportation planning,there are some problems,such as insufficient planning legal basis,relatively backward planning concept,lack of public participation procedures and so on;In terms of the construction and use of intelligent transportation facilities,there are some problems,such as the disunity of facility standards,the lack of facility maintenance management system,and the lack of facility failure relief plan;In the aspect of demand responsive public transport operation,there are some problems such as imperfect market access mechanism and financial subsidy mechanism;In terms of travel information service,there are some problems such as the lack of traffic information sharing,publishing and error correction mechanism;In terms of restrictive traffic information management measures,there are some problems,such as the reservation system of motor vehicle tail number restriction and the traffic congestion charging system is not perfect.Thirdly,it summarizes the traffic congestion control measures and relevant legislative experience of some countries with more developed urban traffic(Britain,the United States and Singapore).It is considered that the UK improves the scientificity of intelligent transportation planning by implementing the public participation procedure in transportation planning;Through the establishment of perfect public transportation market access and financial subsidy mechanism,the service quality of demand responsive public transportation has been improved in the United States;Singapore has effectively controlled the growth of the number of small and medium-sized cars in the city by using advanced technology to collect congestion charges.Finally,some suggestions are put forward to improve the legal system of urban traffic.In the aspect of intelligent transportation planning,we should clarify the legal basis of planning,establish the basic principles of planning,and standardize the public participation system;In terms of the construction and use of intelligent transportation facilities,it is necessary to form the standard system of intelligent transportation facilities,establish the maintenance and management system of urban transportation facilities,and formulate the preparation method of the rescue plan for the failure of transportation facilities;In the aspect of demand responsive public transport operation,the market access and financial subsidy system should be improved;In the aspect of travel information service,the mechanism of sharing,publishing and correcting traffic information should be established;In the aspect of restrictive traffic demand management,we should improve the reservation system of motor vehicle tail number restriction and formulate the traffic congestion charging system of dynamic charging.
