China unveiled its "No 1 central document" for 2021,stressing the efforts to comprehensively push forward rural vitalization and accelerate the modernization of agriculture and rural areas.The document calls for vigorously implementing rural construction actions,accelerating village planning,and strictly investigating and punishing illegal and disorderly construction activities.Illegal construction not only occupies arable land,affects the overall planning of urban and rural areas,damages the image of rural living environment,but also is a stumbling block on the road to realize the modernization of agriculture and rural areas.In practice,the governance of illegal construction in rural areas is often defined as a difficult task because of the conflict of interest and the instability factors.However,the principle of "stability is more important than everything" makes the law enforcers’ governance strategies for illegal construction in rural areas usually present the fuzzy implementation characteristics of "loose and tight at different times,with different leniency and strictness".Based on this,this paper makes use of the ambiguous governing theory,based on the empirical research in D Town,X City,a typical unauthorized construction,and adopts the interview method and literature method to study the operation of the ambiguous governing of unauthorized construction in rural areas.Focusing on the special action of "three clearing and three demolition",the identification and implementation of "one household and one house" in rural homestad and the reform of comprehensive law enforcement in towns and streets,this paper describes the operational characteristics of the ambiguous governing of illegal construction in rural areas,and analyzes the organizational reasons and governance effects of its generation and operation.It is found that the ambiguous governing characteristics of rural areas in D town are significant,mainly in the four aspects of fuzzy objectives,fuzzy responsibilities,fuzzy roles and fuzzy strategies,showing the alternation of daily decentralized law enforcement and mobile law enforcement.This kind of ambiguous governing is mainly produced and operated in its specific organizational logic: first,the rheology of the organizational decision-making environment,rural land management has experienced the change from water farming to strict law enforcement;secondly,the responsibility of illegal construction governance in rural areas has been generalized,which is reflected in the rigid governance responsibility and other pressure responsibility of the grass-roots government,and under the territorial responsibility mechanism,the grass-roots government often plays an important role Playing the role of "all-around nanny".Thirdly,the difficult transition from decentralized law enforcement to comprehensive law enforcement.In order to achieve the equal rights and responsibilities of grass-roots governance,change the weak sense of decentralized law enforcement,and achieve the effectiveness of law enforcement,China continues to promote the reform of comprehensive law enforcement system at the grass-roots level.However,the transition from decentralized law enforcement to comprehensive law enforcement is often not plain sailing.In the transitional stage of reform and transformation,there is often a gap in law enforcement due to the lack of new and old functions,which,to a certain extent,strengthens the dependence of ambiguous governing strategies at the grass-roots level.The governance strategy brings both positive and negative governance effects.The positive effect is that it reduced the conflict of interest,realizes the stability of grass-roots governance,and has a certain value tolerance;the negative effect is that the grass-roots government relies on strategic implementation to form path dependence,which weakens the credibility of government,while the marginal effect of law enforcement force decreases.In order to promote the standardization and sustainability of illegal construction in rural area,This paper puts forward the following policy suggestions: first,to protect the formal governance resources of illegal construction in rural areas;Second,we should tap the informal governance resources of illegal construction in rural areas.
