Study On The Summary Procedure Of Administrative Litigation In Basic Court Of Jilin Province

The administrative procedure law of our country has a special section on the summary procedure of administrative litigation,which provides a legal basis for its application and development,and has great practical significance for the separation of complicated and simple administrative litigation cases.As one of the first pilot provinces of judicial system reform in China,Jilin Province always insists on exploring the summary procedure of administrative proceedings and has achieved practical results.At present,administrative cases in Jilin Province are mainly concentrated in the grass-roots courts.The grass-roots courts realize the quick trial of simple cases and resolve disputes at the grass-roots level in time on the premise of ensuring fairness and justice.However,the application of summary procedure of administrative proceedings in the basic courts of Jilin Province also faces some difficulties,and there are still problems to be solved in practice.Therefore,the study of the summary procedure of administrative proceedings in the grass-roots courts of Jilin Province can start from the analysis of the current situation of the application of the summary procedure of administrative proceedings in the grass-roots courts,sorting out the cases of the application of the summary procedure in the grass-roots courts,and analyze the difficulties existing in the application of the summary procedure of administrative proceedings in the grass-roots courts of Jilin Province.Specifically,the scope of application of the summary procedure remains to be improved,the procedure conversion provisions of the summary procedure remain to be improved,and the trial rules of the summary procedure remain to be refined.Combined with the research results of domestic and foreign scholars on the summary procedure of administrative proceedings,this paper puts forward targeted suggestions to improve the scope of application of the summary procedure,improve the procedural conversion provisions of the summary procedure,and refine the specific trial rules of the summary procedure.In order to improve the summary procedure of administrative litigation,so that it can better play its advantages in the grass-roots courts of Jilin Province,continue to promote the reform of the judicial system of Jilin Province,the construction of a higher level of the rule of law Jilin.
