| In recent years,with the adjustment of the real estate industry policy,more and more real estate developers fall into the dilemma of breaking the capital chain and the assets can not offset the debts,which makes some real estate enterprises can only use the bankruptcy procedure to deal with the debt relationship.For real estate development enterprises,there are several alternative paths to bankruptcy.Some of them use the way of bankruptcy reorganization to rejuvenate,and some also use the way of reconciliation to solve problems.However,for more real estate developers,bankruptcy liquidation is the first choice to deal with such problems.In the process of bankruptcy and liquidation,real estate development enterprises have many rights at the same time.In this case,the problem of which is the first and which is the second is inevitable.In the bankruptcy procedure of real estate development enterprises,it is very important to determine the order of priority payment,which has an important relationship with the orderly progress of bankruptcy procedure,the effective protection of the interests of vulnerable groups,and the effective maintenance of social order.Therefore,it is not only important but also necessary to analyze and study how to clarify the priority and how to settle the right in the bankruptcy procedure of real estate enterprises.This paper analyzes and judges the priority and the order of payment of other creditor’s rights based on the connotation,theoretical basis and application of priority in the bankruptcy procedure of real estate enterprises.This paper consists of four parts.The first part mainly discusses the connotation and legal theoretical basis of the priority of compensation enjoyed by house buyers in the process of bankruptcy of real estate enterprises.The second part mainly introduces the necessity and conditions of the exercise of the buyer’s priority in the bankruptcy practice of real estate enterprises.The third part introduces the problems of the buyer’s priority in the bankruptcy procedure of real estate enterprises.The fourth part introduces the suggestions on improving the priority of the buyer in the bankruptcy procedure of real estate enterprises. |
