On The Determination Of The Crime Of Throwing Objects From High Altitude

The judicial identification of high-altitude parabolic is one of the urgent problems in the current judicial environment.In judicial practice,most of the criminal cases of throwing objects at height are evaluated as crimes of endangering public safety by dangerous methods.Compared with the Criminal Law Amendment 11(Draft)which stipulates it as a crime of endangering public safety,the Criminal Law Amendment(11)adds the crime of throwing objects at height to the second paragraph of Article 291,which constitutes the characteristic of the crime of throwing objects at height.Major changes.The inherent nature of the crime of throwing objects at high altitude to disturb the order of social management.The author will start from the perspective of combining theory with practice.In the first part of the thesis,first analyze the characteristics of high-altitude parabolic,explain the difference with falling objects,and combine with relevant cases of our country to demonstrate the necessity of penalties for high-altitude parabolic penalties.Then,Based on objective and subjective elements,the author tries to analyze the constitutional elements of the crime of throwing objects at height.Then analyze the concurrence of high-altitude projectiles,and the circumstances that constitute implicated.Finally,the author will analyze the current dilemma in the application of the criminal law of my country’s regulation of parabolic behavior at heights and try to make perfect suggestions for the application of criminal law.
