| As a disruptive technology in the 21 st century,artificial intelligence(AI)has achieved great performance in a quite large number of real-world applications,such as autonomous car,precise medicine,smart education,and personalized consultation,which means the interaction between AI and human are closer and closer,and they tend to develop collaboratively.However,as the legal status of AI is not clear yet,it is difficult for human to formulate clear regulations on the potential dangers of AI in terms of privacy,security,ethics,and other aspects in the form of law.In order to deal with the challenges of laws brought by AI,this paper carries out a detailed study on the civil legal status of artificial intelligence and further puts forward some targeted suggestions for the formulation of relevant laws.To be specific,this paper is organized as the following four aspects:First,this paper introduces the concepts and characteristics of AI,and analyzes the differences between weak and strong AI in cognitive level.Then,from the perspective of law,this paper explains the evolution process of civil subject system and the decision-making standard of civil subject,the independent will.Therefore,this part lays a theoretical foundation for AI to have the status of civil legal subject.Besides,based on the different characteristics of weak artificial intelligence and strong artificial intelligence,this paper discusses the difference of the subject status of civil law between them and draws the conclusion that "only strong AI has the subject status of civil law",and further puts forward that the subject status of civil law of strong artificial intelligence should be limited.Finally,from the perspective of establishing and standardizing the dominant position,this paper designs the corresponding control strategy of strong AI,namely the evolution path of "theoretical research-policy practice-clear legislation".And this will further promote the positive and beneficial value of AI in social life. |
