Investigation Report And Countermeasure Analysis On The Existing Legal Problems In The Out-of-school Trusteeship Class For Primary

With the economic development of our country,a large number of off-campus care classes for primary school students have emerged,which is convenient for parents and students,but there are more problems.Most of the existing research focuses on management,education,etc.,and few researchers have paid attention to the off-campus custody classes for primary school students from a legal perspective.The author designed a questionnaire for these legal problems by reading the literature and other predetermined legal problems in the custody class,and distributed it to the parents of students with the help of the questionnaire star platform.The results of the questionnaire finally verified the author’s presupposition.The main existing legal issues of primary school students’ off-campus trusteeship classes include food safety issues and personal safety issues.The author analyzed the reasons for the legal problems in the off-campus custody class for primary school students.One is the lack of a clear legal basis for the rights and obligations of the custody class,the custodian,and the custodian;the second is that there are problems with the supervision rules and application during the entrustment process of the client;the third is the custody class.The relevant laws and regulations between the supervisor and the supervised are not sound.To solve the existing legal problems of the off-campus custody classes for primary school students,we should first clarify the rights and obligations of all parties from the legislative level,and improve the contract law and the law on protection of minors.Secondly,at the level of law enforcement,we should improve supervision and law enforcement such as food safety,teaching,guidance and training,and multi-departmental efforts should be made.Thirdly,at the judicial level,before the relevant laws are perfected,through judicial judgments,signals that the trusteeship team assumes the main responsibility will be transmitted,and the trusteeship team will be deterred from taking precautions;after the relevant laws are perfected,judicial judgments should be strictly enforced,and the number of relevant judgment cases should be increased.Information disclosure and judicial propaganda.Finally,several suggestions are given from the aspect of supporting social rules:develop commercial insurance for custody risks,and encourage qualified schools to provide paid custody services.
