| Compared with ordinary civil cases,family cases have the characteristics of emotion,privacy and public welfare.Solving individual disputes is not the only purpose of family lawsuits.The family is the cornerstone of society.Repairing family relationships through the Family Court,making up for the emotional scars between family members,protecting the vital interests of minors,and achieving the effect of social restoration is the goal pursued by family trials.With the continuous increase of the modern divorce rate,minors’ parenting and education issues in family affairs cases have become more prominent.If the interests of minor children cannot be effectively protected,it will inevitably have a profound impact on the stable development of society.Therefore,how to effectively protect minors in family cases has very important research significance.Due to insufficient physical and psychological development,minors are often in a disadvantaged position in family affairs cases and require special protection.Since the establishment of family affairs pilots across the country,the protection of minors has achieved preliminary results.The court’s family trial working mechanism and methods of protection of minors were investigated to clarify the current status and corresponding characteristics of minor protection.At the same time,it was found that the current pilot program of family courts in q County still lacks protection for minors,mainly due to the lack of protection for minors.Adults cannot truly participate in family litigation in parental divorce cases,and corresponding family investigations and psychological protection measures are insufficient.By summarizing the practical experience of family courts in q County,guided by the principles of maximizing the interests of minors and the principle of power detection,based on practice and drawing on relevant experience from outside the territory,in response to the problems arising in the pilot,it is proposed to promote the reform of minors in family trials Recommendations for protection,so as to effectively protect the rights of minors in family trials. |
