In recent years,with the continuous development of my country’s economy and the continuous improvement of the level of urbanization,the people’s living standards have also achieved a qualitative improvement,but the subsequent imbalance in economic development and the large gap between urban and rural development have become prominent problems.The report of the 19 th National Congress of the Communist Party of China put forward the strategy of rural revitalization.The report pointed out that we must adhere to the general requirements of industrial prosperity,ecological livability,rural customs,effective governance,and affluent life,improve the urban-rural integration development system and policy system,and accelerate the promotion of agriculture.Modernize rural areas and promote rural development.However,due to my country’s restrictions on homesteads,when farmers want to mortgage their homes to obtain the funds needed for production and life,the lack of available collateral has caused difficulties in financing,which is not conducive to the development of rural industries,and also hinders the development of rural industries.This improved the level of rural economic development.In 2015,my country launched a pilot project for mortgage of homestead use rights in some pilot areas.The relevant policy documents issued by the Party Central Committee proposed that new forms of mortgages should be explored,and rural guarantee methods should be innovated.The steady progress of mortgage work has eased the problem of rural financing difficulties to a certain extent,injected new vitality into rural economic development,and promoted the development of rural areas,agriculture,and farmers.However,there are still many problems and shortcomings that need to be solved urgently.By analyzing the measures and practices of the mortgage of homestead use rights in pilot areas,we will absorb their valuable experience and study how to break through the dilemma of homestead use rights mortgage and solve the existing problems.The question has a certain reference value.The main research purpose and innovation of this thesis is to focus on the problems and difficulties in the mortgage of rural homestead land use rights,analyze the reasons and put forward countermeasures and suggestions.The first chapter is the introduction.It introduces the research background,research purpose and significance of this article,a summary of domestic and foreign research,the research content of this article,a summary of domestic and foreign research,research methods and ideas,as well as the innovative points and important difficulties of the thesis.The second chapter is the key concepts and theoretical basis of the research.This chapter mainly expounds the concepts of homestead,homestead use right and homestead use right mortgage,as well as the theory of resource optimal allocation and the theory of institutional change,and further clarifies the objects to be studied.The third chapter is to analyze the current situation and predicament factors of the mortgage of homestead use right in our country.Summarize and analyze the laws and policies related to the mortgage of homestead use rights in my country and the local policies introduced in some pilot areas.From a macro perspective,it analyzes the current mortgage model of homestead use rights in my country,and summarizes the use of homesteads in my country.The main dilemma of mortgage rights and the reasons for the dilemma.Chapter 4 analyzes the typical models of domestic and foreign rural property rights mortgages.Through the analysis of the models and typical cases of homestead use rights mortgages in Ningxia,Sichuan and Zhejiang in my country,combined with the experience of the rural property rights mortgage models in the United States and Japan,further Understand the operation links of mortgage of homestead use right,and provide empirical reference for follow-up research.The fifth chapter puts forward countermeasures and suggestions to optimize the mortgage of homestead use right in our country based on the above research.This chapter combines the status quo of the mortgage of homestead use right in our country and the experience of domestic and foreign countries in the first three chapters,and puts forward feasible countermeasures and suggestions under the background of rural revitalization.Chapter 6 is the conclusion and outlook.This chapter summarizes the basic thesis of the thesis,summarizes the significance and conclusions of the research,points out the deficiencies of this article,and proposes future research directions.
