On The Nature Of Community Correction Of China

The nature of community corrections determines the overall design of the community corrections system and the direction of community corrections practice.Therefore,it is an overall and fundamental issue in the community corrections system.The establishment of the community corrections system in our country is a major manifestation of the development of our country’s penalty civilization and the concept of penalty,and it is also a guide and promotion for the overall development of my country’s penalty system.Community corrections in my country not only punish and reform criminals with the guarantee of national coercive power,but also use community resources and social forces to promote the resocialization of criminals.Combining the development of penalty theory and the development of community corrections in our country for more than ten years,it can be considered that my country’s community corrections system has a complex characteristic of integrating penalty enforcement and social work.Therefore,understanding the nature of community corrections in our country needs to adhere to a dual perspective.The specific manifestations are as follows:On the one hand,my country’s community corrections have the nature of penalty enforcement.Breaking away from penalty enforcement will shake the foundation of community corrections;The community corrections of the People’s Republic of my country have the nature of social work,which is determined by the characteristics of the correction of criminals that are different from those in prisons.This article first sorts out,summarizes and reflects on the main views of the academic circles on the nature of community corrections in China,and summarizes the consensus and specific disputes reached by the theoretical circles on the nature of community corrections;secondly,from the two aspects of theory and practice discussed the basis of the nature of community corrections in our country;again,a reasonable definition of the nature of community corrections,the nature of community corrections in China is dualistic,that is,penalty enforcement and social work,the nature of penalty enforcement and the relevant provisions of the Community Corrections Law and the local environment Under the social and cultural concepts,it is also conducive to the realization of the purpose of punishment;social work has a welfare attribute,and has an inherent compatibility with community corrections in terms of work philosophy,work subject,work objectives and work methods;finally,it points out certain problems in the specific implementation of the nature of community corrections in my country,such as excessive emphasis on supervision and punishment,the limited role of professional social workers in community corrections,and the specific problems of low social participation.In response to these problems,reasonable allocation of community corrections law enforcement personnel,establishment of social worker talent education,occupational access and review systems,and promotion of social forces to participate in community corrections are reasonable solutions.
