| The courts are judicial organs in China,for a long time,the personnel management in courts has been a single administrative management system.Judges,judge assistants,clerks,executors,judicial policeman and judicial administrative personnel are under administrative and bureaucratic management.Their salary range,promotion channels are same as those of civil servants in integrated management types,did not show professional characteristics,which seriously affected the enthusiasm of the court staff,thus restricting the judicial justice.In order to show its distinctive professional characteristics,the court should establish the personnel classification management system that in line with the present situation,classify the personnel according to the post properties,research and explore a more practical and operable personnel classification management mode.During the twenty years from 1999 to 2019,the Supreme People’s Court issued the First Five-Year Reform Outline for the People’s Courts to the Fifth Five-Year Reform Outline for the People’s Courts,each reform outline mentioned the need to deepen the reform of judicial system and implement the reform of the personnel classification management in courts.The reform of the personnel classification management of courts is the fundamental section in the reform of judicial system and an important symbol of the exploring a new system of personnel management in line with Chinese basic national conditions.Over the years,the reform of personnel classification management in the primary courts has not been fully implemented because it touched parties’ interests and restrained by local policies.This paper takes the study of the current situation of personnel classification management in G county court in Hubei province as the starting point,analyzes the problems and causes of classification management,draws on the advanced experience of courts at domestic and abroad,in order to explore the establishment of a set of scientific personnel classification management system which in line with the reality of primary court.This is conducive to fully mobilize the enthusiasm and initiative of policeman in primary courts,improve the trial efficiency,realize the standardization of personnel system of the primary courts,and truly realize the construction of regularization,specialization and professionalization of political-legal ranks.This paper is divided into six parts.The first part expounds the purpose and significance of studying the personnel classification management in the primary courts,elaborates the research status at home and abroad,and the research thoughts and approaches.The second part introduces the concepts and theoretical basis of the personnel classification management in the primary courts.The third part elaborates the historical evolution and present situation of the personnel classification management and the forth part analyzes the problems and reasons in the reform of the personnel classification management in the primary courts.The fifth part probes into the personnel classification management practice of the foreign courts and the domestic pilot districts with aim to draw on advanced experiences.The sixth part puts forward scientific suggestions to improve the personnel classification management system in courts. |
