Problems And Countermeasures In Criminal Judicial Expertise In My Country

As an important part of my country’s criminal litigation activities,criminal judicial appraisal has played a huge role in identifying specialized problems in criminal cases for a long time.The prerequisite for the application of criminal judicial appraisal procedures is that judicial staff are affected by complex specialized problems and are limited to their personal professional capabilities,leading to difficulties in understanding the facts of the case.At this time,the expert will provide scientific answers to the complex problems in the case.Criminal judicial appraisal,which is the application of scientific cognition activities in judicial practice,is different from other litigation activities,so it has both scientific and legal attributes.Since criminal judicial identification depends on the personal ability and moral quality of the authenticator,identification activities will be subjective inevitably.Therefore,the law also stipulates the principles of legality,impartiality,independence and objectivity of judicial identification to strengthen the constraints of forensic appraisal activities.But in the final analysis,criminal judicial appraisal serves criminal litigation,and the entire criminal judicial appraisal process must conform to substantive justice and procedural justice,which is also the focus of this article.Based on the "Decisions of the Standing Committee of the National People’s Congress on Judicial Appraisal Management Issues" and "General Rules of Judicial Appraisal Procedures",this article analyzes the current situation of criminal forensic appraisal in my country,expounds the relevant concepts of my country’s current criminal forensic appraisal,and points out through empirical analysis.The problems of criminal judicial appraisal in our country,such as low access registration conditions for appraisal subjects,imperfect criminal appraisal procedures,and lack of professionalism in the review body of appraisal opinions,have seriously damaged the credibility of criminal judicial appraisal in our country.Based on the investigation and analysis of the criminal judicial appraisal system of typical foreign countries,this article combines the reform experience of some regions in my country to improve the registration and management system of appraisal subjects in our country,improve the criminal judicial appraisal procedures,and strengthen the professional review of appraisal opinions,in order to make my country’s criminal judicial appraisal system more perfect and the credibility of criminal judicial appraisal improved,and finally realize judicial justice.
