| The protection of the basic rights of citizens in a state of emergency has always been a topic of concern to the international community.With development,new problems emerge one after another,posing new challenges to the stability of human society.Today,with the rapid development of information technology,how to guarantee the effective exercise of civil rights is a new topic for us.In the face of this COVID-19 epidemic,we deeply feel how important it is to guarantee the basic rights of citizens under the state of emergency,and the significance of human rights protection directly affects the success or failure of the whole situation.This paper takes the initial measures taken by Wuhan City for epidemic prevention and control as the entry point,and makes in-depth reflection and summary on some problems in the prevention and control,and draws lessons from experience.Therefore this article mainly from four parts to specifically describe the related questions of citizens’ basic rights and obligation under emergency state,the first part mainly revolves around the concept of a state of emergency,the running characteristics of the emergency power and account outside the law to western countries,thus further strengthen understanding theory of the state of emergency.The second part from the state of emergency restrictions and guarantee of citizens’ basic rights,respectively from the limit of legal basis,principle and safeguard of deeply analysis the necessity and specific performance,want mature theory of experience can be better applied to the practice,to fundamentally achieve the balance between human rights and state power.The third part mainly takes the epidemic prevention and control in Wuhan City as an example,and carries out a specific discussion on the problems caused by the restrictions on the basic rights of citizens in the epidemic prevention and control and the shortcomings of relevant legal documents in practice,so as to more intuitively feel the impact on the basic rights of citizens under the state of emergency.The fourth part is to put forward more targeted and perfect strategies for this epidemic and China’s specific national conditions. |
