Study On The Implementation Of "The Regulations On The Creation Of Model Areas Of National Unity And Progress In The Tibet Autonomous Region"

The law is "the organic unity of static and dynamic," “the organic unity of empirical and value," "the unity of legal practice and legal culture," and The Regulations on the Creation of model areas of national unity and progress in the Tibet Autonomous Region(at the third session of the Eleventh National People’s Congress of the Tibet Autonomous Region(referred to The Regulations at below).Keeping up with the development of the era,Summering historical experience,focusing on people’s wisdom and reflecting public opinion,is the first local law in the unity of ethnic in Tibet.For the first time,the "Model District Creation" was proposed in the form of local legislation,which took opposing separatism as the shared responsibility and obligation of all ethnic groups in the region,and included religion-related content,reflecting distinct Tibetan characteristics.The introduction of The Regulations has a symbolic significance.It provides the rule of law for ethnic unity and progress in Tibet in the new era,establishes a perfect system of ethnic statutes and regulations,helps promote the development of the project of governing Tibet according to law,and provides material for the study of ethnic jurisprudence.The Regulations include 48 articles in 8 aspects,including general provisions,job responsibilities,social cooperation,publicity and education,creation and recognition,organizational protection,legal obligation,and supplementary provisions.Since The Regulations implementation on May 1,2020,the party committees and governments lead and push down the whole society,various work to appear new situation and received extensive attention and respect from the community.There was a rapid upsurge of publicity and academic research in Tibet.The research results frequently appear in newspapers and media and have been included in law education content.As an essential starting point to enhance the legal awareness of cadres and the masses and the rule of law,the relevant supporting policies and regulations are gradually implementing.The construction of the model area of ethnic unity and progress is continuously promoting.However,due to the lack of relevant supporting laws and regulations policy and evaluation index system,an insufficient extension of publicity and education,cadres and masses of legal awareness and the rule of law belief is relatively weak,supervision and inspection mechanism is not perfect the implementation of selection and recognition standards is not in place,insufficient social coordination and other obstacles,resulting in the performance of the Regulations and the reality of deviation.The Regulations’ implementation is a systematic project,and we must work hard for a long time.To this end,this paper proposes to strengthen legislation in the field of national unity,to make good use of the legislative authority granted by the Legislation Law,to strengthen legislation in the aspects of urban ethnic work and halal food,and make up for the legal gaps with policies;Improving oversight over the enforcement of laws and regulations concerning ethnic minority affairs,make good use of the sharp sword of inspections,and give full play to the NPC’s role in legal supervision and administrative inspection of law enforcement.We are working hard to cultivate our thought and belief in the rule of law,continuing to make it a long-term basis for the people to popularize the law and abide by the law.Paying great attention to the cultivation of the awareness of the rule of law among the critical minority and handle and distinguish between two different types of conflicts following the law.It is necessary to strengthen legal personnel’s construction,innovate the legal personnel’s training mechanism,build a high-quality legal team,and strengthen the legal service team structure.Focusing on law enforcement in key areas,focusing on the anti-separatist struggle in Tibet,managing religious affairs under the law,and protecting the people’s rights to know,participate in,and be supervised by the law.The quality of academic research and theoretical research on implementing the Regulations should be continuously strengthened.
