Research On The Construction Of Security Measures System For Juvenile Delinquency

The social structure was greatly changed by the high material standard of living,,but also a series of new social problems,the most important of which is Minors commit crimes against the law.Countries around the world consider the above issues to be urgent tasks and problems to be solved in view of the special identity of adolescents and the role they play in national development.As a special treatment method,security punishment has the function of making up for and replacing criminal punishment,Security punishment system has gradually become the best way to deal with Minors commit crimes against the law.In the field of preventing juvenile crime,security punishment system has played a great role,so a lot of people very respect and love it! In the long history of our country,although there is no prescribed system of security measures,but there are also relevant measures of security measures,still plays an active role in combating crime.However,compared with the perfect security system in European countries,the existence of China security measures system is very scattered,most of which are administrative security measures,and lack of unified written norms or social practice standards,in the process of implementation can not rely on,implementation is not based,so that the security measures system of prevention and treatment of the role of greatly weakened.Although China has always attached great importance to Minors commit crimes against the law,but the Minors commit crimes against the law incidents reported in the news in recent years show that there are still some problems in China,and We should establish a perfect security punishment system,rather than to establish a punishment system for revenge.The article is divided into four parts:The first part mainly writes three typical cases and the practical problems related to juvenile delinquency contained in the cases.The article listed three typical cases where minors had evil thoughts due to different reasons such as family and school,which caused irreversible and serious consequences.Looking at the phenomena reflected in the three cases,we then discuss whether minors are the targets of security measures,and whether security measures are appropriate to deal with minors’ problems.Further analyze what are the key prerequisites for the selection of security measures.The second part mainly discusses the legal theory knowledge involved in the case.To make a statement,you need to be specific to each issue in order to have a strong conviction.According to China’s criminal policy on juveniles,its advantages and disadvantages are analyzed.The author enumerates a series of viewpoints and the status quo of security measures in China on the prevention of juvenile delinquency,and then evaluates them.The third chapter is mainly the case problem analysis,analyzing the similarities and differences of the three cases,the existing common problems,and the analysis of the differences in the application of the three typical cases.Although the punishment is the effective measure to punish illegal crimes,the penalty is also the most effective measure.Severe measures are irreversible,so there is a big controversy over whether to lower the age of criminal responsibility or not.Security measures also produced different effects when used,analyze the reasons.The fourth part is the result and inspiration of the case study.We analyze that lowering the age of criminal responsibility is not the right way to control the younger age of crime.We also listed the construction of security punishment system in other countries,learning from their good places and discarding their bad places.We analyze the security punishment system from macro and concrete aspects to construct and improve it.
