A Study On The System Of Criminal Supervision In Mongolian Area Of Qing Dynasty

Li-Fan Yuan Code is a collection of national legislation in Qing Dynasty,and a treasure in the jungle of Chinese legal culture.Through the compilation of Jiaqing dynasty,Dao Guang dynasty and Guang Xu dynasty,Li-Fan Yuan Code is rich in content and wide in scope of adjustment,which involves all aspects of Mongolian society in Qing Dynasty.The criminal supervision system in Mongolia in Qing Dynasty is an important part of the judicial system of Li-Fan Yuan Code.Under the comprehensive effect of Li Fan yuan is a national code based on the "Mongolian Law" and the "Mongolian Law",absorbing the basic spirit of the " Qing Law ",relying on the "Qing Huidian",and retaining the Mongolian traditional legal system.In this sense,the legislation of the supervisor’s crime system is gradually perfected through three stages: the initial legislative stage,the systematic legislative stage and the mature legislative stage.According to different standards,the object of the system of supervising criminals can be divided into different types,and the system requires the offender to bear certain responsibilities and obligations.On the other hand,different supervision measures are applied to different types of offenders;As ancient China implements the system of the integration of judicial administration,the administrative organ is the judicial organ of the supervising person’s crime system,and the reward and punishment of the duty and ability of the judicial organ and the personnel supervisor are the main contents of the supervising person’s crime system.The arrest,arrest,imprisonment and deportation of criminal are important links in the operation of the supervision system.These procedural provisions restrict the subject of the supervisor to perform his duties according to law,and make the supervision of criminals more standardized and institutionalized.The object of supervision,the subject of supervision and the procedure of supervision are the constitution of the system.From the point of view of comparison with the mainland,the system of supervising criminals in the Qing Dynasty Mongolia has unique characteristics of Mongolian nomadic society:From the central to the local level,the supervision system is relatively complete,the regulation of burglars is attached importance to,the severity of the punishment of escape,the regional characteristics of the supervision procedure,the location of the prisoners is "the principle of proximity",and the uniqueness of the way of supervising criminals.Combined with the cases in the archives and historical materials,the system of supervising and committing crimes in the area of Qing Dynasty has certain effectiveness.
