In civil litigation,the lawyer plays an irreplaceable function in resolving the contradictions and disputes of both personal and property relationship between equal subjects.However,the professional ethics and level of practice of the lawyers in civil litigation vary greatly.As for this,the management system of the lawyers is fully stipulated in the Law of Lawyers.It is beneficial to for the lawyers of civil litigation to improve their professional ethics and maintain the lawful rights and interests of the party better.Being diligent and dutiful is the primary obligation of the lawyer’s professional ethics.Being diligent and dutiful requires the lawyers of civil litigation to perform functions and duties carefully in their practice,to put endeavor to their work and never to be slackening.However,there are still some imperfects for the lawyers of civil litigation to implement their obligation for being diligent and dutiful.For instance,the relevant standards and methods for judging the lawyers’ obligation for being diligent and dutiful are insufficient.In addition,the reward and punishment mechanism of the lawyers is not perfect.All of these problems make the lawyers unable to fulfill their obligation for being diligent and dutiful.Therefore,the obligation for the lawyers of civil litigation to be diligent and dutiful should be improved;the standards and methods for identifying the obligation to be diligent and dutiful should be made explicit;and the award and punishment mechanism of the lawyers should be improved.The study of the lawyer’s obligation for being diligent and dutiful in civil litigation plays an active role in improving the professional ethics and level of practice of the lawyers in civil litigation of our country.Meanwhile,it provides theoretical support for the construction of the lawyers’ system of China.
