In the 21 st century,the problem of drug abuse has become a serious legal problem of the international community and even caused various social problems.The addictive behavior of taking and injecting drugs(hereinafter referred to as drug-taking behavior)widely exists in all parts of the world,all races and all strata.In Modern China,drug-related crimes and drug-taking behaviors are also repeatedly banned,which seriously endanger social peace and citizens’ health.China has always attached importance to drug prohibition,and in recent years has introduced laws and regulations such as the anti-drug law,and set up a system of compulsory isolation for drug rehabilitation to help drug addicts get rid of their addiction.However,with the development of society,the current compulsory isolation drug treatment system has some deficiencies and needs to be rebuilt and improved.Based on the investigation and analysis of the overall and regional implementation of the system,the current system of compulsory isolation for drug rehabilitation is operating on its own,there are some situations,such as the lack of detailed legal rules,the lack of perfect rights design,the conflict of relevant norms,etc..In the external connection,there are some problems such as the management mechanism is not unified,the connection mechanism is not tight,etc..In the law enforcement link,lacks the system effective supervision,urgently needs to fill the position.In view of the decriminalization and non-punishment of compulsory isolation drug treatment,China should promote the special legislation of compulsory drug treatment measures as soon as possible,and improve the systematic and scientific nature of the system.The separation of decision-making power and execution power should be established in the system,the drug addicts should be managed at different levels,and the mechanism of social force to help the drug addicts return should be optimized.In terms of rights protection,the legal rights of drug addicts are protected by strengthening the supervision of the power organs,the judiciary,the procuratorial organs and all sectors of society over compulsory isolation for drug rehabilitation.At the same time,we should also start with the construction of a standardized law enforcement system for compulsory isolation drug treatment,the establishment of a unified management system for compulsory isolation drug treatment,the promotion of a unified basic model for judicial and administrative drug treatment,and the implementation of a diversified scientific drug treatment system for joint treatment,we will improve the supporting measures for compulsory isolation and drug rehabilitation.
