Research On Legal Concept And Normative Function Of Wildlife In Chinese Law

The Covid-19 which outbreak in 2020 has brought the topic of animal protection to a new perspective.Because the law has national coercive force,it has become a way that people place high hopes in the field of wildlife protection.In the current situation of the normalization of epidemic prevention and control,"Law of the People ’ s Republic of China on the Protection of Wildlife","Criminal Law" and other legal texts on wildlife protection are also in continuous and intensive revision.In the process of amending the law,the definition of the legal concept of wildlife as the most basic issue has become the focus of discussion.At present,when talking about the revision of wildlife protection law in China,most scholars have proposed that the scope of wildlife protection needs to be expanded to better achieve the effect of wildlife legal protection,but how to define and expand to what category are still unsolved problems.Because of these problems,the obstruction of legislative purpose leads to the difficulty of effective realization of biodiversity and ecological balance,the first principle of protection priority is restricted and the difficulty to implement the specific system of wildlife protection.On the basis of proving the necessity of adjusting the legal concept category of wildlife from both theory and practice,this paper analyzes the changing trend of the concept category of wildlife in the process of historical development from the dual perspectives of biology and law.According to the future prospects of the legal concept of wildlife in China,based on the practical needs,this paper puts forward a new way to define the legal concept of wildlife,so as to achieve the actual effect of wildlife protection.Finally,the normative role of the revised legal concept of wildlife is analyzed.The advantages of the new legal concept category in the maintenance of biodiversity and ecological balance are studied.The important principles of how to achieve the priority of protection and how to promote the implementation of wildlife protection system are discussed.Through the new construction of the legal concept of wildlife,we can better protect them.
