Research On The Punishment Mechanism Of Personal Trustbreaking In The Construction Of China’s Social Credit System

The discussion of "credit" in China has been around since ancient times.With the development of China’s social economy and the continuous improvement of market activity,the concept of credit has gradually generated a new meaning in market activities.At the same time,in foreign markets,the credit system has been quietly spread.Market economy in our country today,international and deepening of opening to the outside world,China’s commercial trading of credit system construction and management is lagging behind the market,thus derived many credit related to the economic,social,legal and ethical issues,the emergence of these problems make people once thought our country credit system has collapsed,be badly in need of a thorough social credit system construction and reform,in order to reverse the lack of credit society in an all-round way,to rebuild the social credit system in our country.In 2014,the State Council promulgated the Outline of the Plan for the Social Credit System(hereinafter referred to as the Outline),which proposed the establishment and improvement of a social credit operation mechanism focusing on a system of rewards and punishments,and the construction of a social credit system with Chinese characteristics that suits China’s national conditions.In a social credit system,the punishment system is the final guarantee and the necessary means of the credit system.If we want to perfect our social credit system,we must establish a perfect reward and punishment system as stated in the Outline.Credit agencies in China in recent years also gradually obtained the full development,are marching towards a complete social credit service system,as the most basic,the most important in the whole credit system of the individual,is still faced with the plight of many credit services,this article from the credit system construction of dishonest people in the process of punishment mechanism,this paper analysis the lack of personal credit service faithless punishment mechanism.The main content of this paper can be divided into four parts: The first part firstly sorts out and explains the concepts of "credit","credit investigation" and "punishment for trust-breaking" from the semantic and origin,and points out the latest research results of such concepts in the academic circle.The second part mainly describes the main ways of punishment for trust-breaking in China and the problems presented in practice,and then clarifies the defects of the punishment mechanism for trustbreaking in China.The third part mainly includes the analysis of the characteristics of several major credit management models and the sorting out of the measures of individual trust-breaking punishment on behalf of the state,from which the similarities and differences are analyzed and the commonalities are extracted.In the fourth part,combining with the analysis of the defects of China’s personal trust-breaking punishment,and drawing on the experience of foreign personal trust-breaking punishment,the framework of China’s personal trust-breaking punishment system construction is put forward,trying to construct a personal trust-breaking punishment mechanism in line with the development needs of China’s social credit system.
