On The Legal Issues Of The Inheritance Of Online Stores In China

With the development of Internet economy,online shop has become an indispensable necessity in the "Internet Age" in a short time.However,with the rapid development of online stores,online store disputes also occur.The emergence of individual online shop dispute cases in China for the first time has opened a new journey of legal research on online shop in China.The emergence of disputes over the succession of personal online stores in China has aroused extensive heated discussion among domestic scholars on the legal issues of the succession of online stores.Many foreign countries have issued relevant laws and regulations on the inheritance of network virtual property,but there are few discussions on the legal issues of network stores.China’s relevant laws and regulations on network virtual property mainly involve Article 127 of the civil code,which takes network virtual property as the object of civil law protection,which is of milestone significance.However,this article does not clearly define and interpret the network virtual property,and there is no clear provision on whether the personal network store belongs to the virtual property.Based on the theoretical analysis and practical exploration of online store inheritance,this paper studies the legal issues of online store inheritance in China.First of all,this paper deeply discusses the basic theory of online stores,defines the legal attribute of online stores,and expounds the social necessity and legitimacy of online store inheritance.Secondly,combining with the existing legal provisions,this paper deeply analyzes the current situation and practical problems of China’s legislation,and sums up the problems existing in China’s online store inheritance,such as imperfect legal basis,unclear right object and value evaluation Finally,through the analysis of the value of online stores,this paper discusses the theoretical value and practical value of online stores,and puts forward some suggestions on the inheritance of online stores from the aspects of the legal system,the inheritance object and the value evaluation of online stores Suggestions on the construction of relevant rules of right bearing.The research on the inheritance law of online stores is related to civil rights and affects the legitimate rights and interests of citizens.It has become an important legislative task to improve the inheritance system of online stores in China,which can not only promote the construction of the rule of law,but also safeguard the legitimate rights and interests of our citizens.In this paper,the legal nature of online shop is defined as the object of real right,and the point of view that online shop is a virtual collective property can be inherited is insisted.In view of the existing legal problems,targeted solutions are put forward.On the one hand,it provides theoretical support for the construction of China’s online shop inheritance system;on the other hand,it helps to improve the legislation and judicial protection of online shop inheritance,so as to contribute to the improvement of China’s legal system.
