Research On Citizen Participation In The System Of People’s Jurors

As an embodiment of the principle of "people-centered" rule of law,citizen participation plays an important role in promoting judicial democracy,justice and credibility in China.For a long time,it has been exposed in trial practice that some citizens are "not enthusiastic when participating in jury elections","passively at the time of jury","silent at trial" and other issues,which have affected the judicial effect of the people’s jury and also violated.The original intention of the design of the people’s juror system.In 2018,the People’s Juror Law of the People’s Republic of China was promulgated and implemented.It carried out some drastic reforms to the people’s juror system,and solved some of the problems in the law and practice.However,from the practice of more than two years,citizens Some stubborn problems of participating in the people’s juror system have still not been completely resolved.From the perspective of citizen participation,this article puts forward suggestions for optimizing the people’s juror system based on practical investigations and practical problems.This article is divided into three parts.The first chapter investigates the status quo of citizens’ participation in people’s jury in the grassroots courts of Huangpu District,Guangzhou through practical surveys,questionnaire surveys,interviews and other methods from the perspective of citizen participation.Taking the time course of citizens’ participation in jury as the horizontal axis,Explore the subjective awareness of participating citizens,the selection process,training guarantees,and participation in the trial,and find out the actual problems of citizens participating in jury;the second chapter clarify the relevant concepts,from the elements of the theory of citizen participation and the people’s jury system,study the significance of the theory of citizen participation in the people’s jury system.explore the experience of foreign citizens toparticipate in the jury,provide reference for the improvement of the people’s jury system;the third chapter find out the problems of citizen participation in the jury,analyze and explore the specific problems of citizens’ subjective awareness,selection process,training security,participation in the trial;the fourth chapter,in view of the problems found in the investigation,puts forward suggestions to improve the people’s jury system,including improving the people’s jury awareness,relaxing the conditions for the selection of people’s jurors,strengthening the performance ability of people’s jurors,improving the ability of people’s jurors to participate in the trial,and strengthening the quality of people’s jurors Performance evaluation,etc.
