Research On Copyright Protection Of Artificial Intelligence Generated Content

Artificial intelligence(AI)as a matter of changing the world and human life style of modern science and technology,now is no longer only simple filtered for huge amounts of data integration work,but also convenient in our life to the legal system and law and order has brought the unprecedented challenge.The challenge is time and global in the civil subject,personality right law,tort liability law,copyright law,and other aspects of the current legal system of contradictions and frictions.Similar works face blowout growth forms of artificial intelligence to generate content,on the basis of China’s copyright law "person" and "artificial personality" protection for the copyright owner,it is hard to include artificial intelligence.How not to shake the foundations of the copyright law system to protect and regulate artificial intelligence to generate content is pressing challenges.This paper is mainly divided into four parts to elaborate and summarize the copyright protection of AI generated content.The first part mainly discusses the protection of the basic theory of artificial intelligence to generate content,including the concept of artificial intelligence and artificial intelligence to generate content defined,specified in this paper,the protection range of the study from the development of artificial intelligence as well as the development trend of the development status of looking to the future.And analysis of artificial intelligence to generate content shall be protected by the law of necessity.The second part mainly discusses the obstacles existing in the copyright protection of the content generated by artificial intelligence at the present stage,including the obstacles of subject and object.The subject obstacle lies in that the artificial intelligence is not human and the copyright in our country is based on the protection of human creation,so the subject of artificial intelligence is not qualified.The object obstacle is that the content generated by artificial intelligence cannot become a work after analyzing the originality elements of the work.The third part mainly discusses how to protect and regulate AI generated content outside the territory,including the protection mode of works,the protection mode of anti-unfair competition law,the protection mode of "cyborg" and the protection mode of neighbor right,and analyzes the advantages and disadvantages of several typical protection modes and the enlightenment to our country.The fourth part mainly aims at the protection of the mentioned difficulties puts forward a theoretical solution,the rationality of the analysis relating right protected mode no matter from the aspects of legislative purpose and value system of the object or subject relating right can better accommodate artificial intelligence to generate content.We can consider to add data information promulgator and puts forward some concrete system idea such as signature system,registration system,narrowing the scope of rights,and shorten the duration.
