The Constitutional Protection Of Chinese Citizens’ Environmental Rights

In the process of strengthening the socialist ecological civilization,citizens pay more and more attention to the environmental rights.The protection of the integrity of the ecosystem has become an unavoidable problem,and the protection of citizens’ environmental rights has become a problem worthy of study in the constitution.Regulating citizens’ environmental rights from the constitutional level is a response of the constitution to the needs of the contemporary environmental era.It can provide certain social value for citizens’ environmental rights,provide a strong guarantee for citizens’ survival and development in a beautiful environment,and also protect the integrity of the ecosystem,better protect citizens’ environmental rights,and realize the effective use of resources,Avoid the tragedy of the commons,embody the core value of the Constitution and establish the authority of the constitution.This paper summarizes the connotation of "environmental right" and "citizen’s environmental right" respectively,confirms the nature of citizen’s environmental right,and analyzes the social attribute and basic human rights attribute of citizen’s environmental right.Through sorting out the constitutional protection mode of citizens’ environmental rights in American states,Japan and South Africa,this paper analyzes China’s reference to the constitutional protection of citizens’ environmental rights from outside the region,absorbs the nutrition of constitutional protection of citizens’ environmental rights from outside the region,and better guarantees citizens’ environmental rights.Through the preamble,Article 9 and Article 26 of the Constitution,this paper conducts a normative analysis of the environmental provisions of the Constitution,and clarifies the prominent phenomenon that the administrative part leads the legislation and the unclear rights and obligations in environmental legislation.To strengthen the protection of citizens’ environmental right,not only need to increase the constitutional interpretations about the environmental right of citizen,also need to implement the "ecological civilization" "beautiful China" constitution promises,by the environmental protection act in the legislative level,confirm the environmental right of citizen in the fulfillment of administrative levels to strengthen the implementation of the government’s responsibilities obligations,in the judicial level,perfect the relief of citizens to report action,At the same time,we should strengthen environmental education for citizens,pay attention to the cultivation of citizens’ awareness of environmental rights,and form good habits of green travel and waste classification from daily behaviors.In this kind of thinking,the constitutional protection of citizens’ environmental rights is analyzed,so as to better protect citizens’ environmental rights and reflect the core value of the Constitution.
