Research On The Anti-unfair Competition Regulation Of Network Click Farming

As an emerging shopping model,online shopping has not only provided convenience for the society,but also spawned an increasing flood of illegal behavior.In order to obtain more market share,online shop operators have implemented a variety of unfair competition behaviors that destroy the order of the market economy,and the the behavior of network click farming is typical.However,the current regulations on network click farming are scattered in various laws,such as “the Consumer Rights and interests Protection Law” and “the Electronic Commerce Law”,as the principal legal basis,and “the relevant provisions of the Anti-unfair Competition Law” and regulatory enforcement activities also have shortcomings.Therefore,this paper studies how to perfect “the Anti-unfair Competition Law” and improve the anti-unfair competition supervision system to make it more systematic to regulate the network click farming behavior.In addition to the introduction,the full text consists of four chapters.The first chapter summarizes the network click farming,introduces the concept and characteristics of the network click farming,and clarifies the nature of the network click farming.The second chapter points out the harm of network click farming,expounds the necessity of regulating network click farming,and points out the feasibility of anti-unfair competition law to regulate network click farming.The third chapter expounds the current situation and problems of the anti-unfair competition law system of the network click farming,combined with the newly revised “anti-unfair competition law”,aiming at the typical unfair competition behavior of the network click farming,this paper analyzes the shortcomings of the law in regulating the network click farming,including the omission of the responsible subject,Improper punishment regulations,and the imperfect supervision system.The fourth chapter puts forward some suggestions to improve the legal system of network click farming against unfair competition.In order to prevent the spread of network click farming in our country,some practical countermeasures and suggestions are put forward,including increasing the responsible subject of network click farming,clarifying the punishment regulation of network click farming,perfecting the supervision system of network click farming,which is of great significance to protect the rights and interests of consumers and legitimate merchants,to establish a healthy,orderly,objective and fair network trading environment,and to maintain the normal and good operation of online shopping platform.
