Since the reform and opening up,the development of development zones has developed rapidly from scratch.Facts have proved that the development zone has been an important engine to lead China’s economic development,and it is also an important field for China to explore the reform of government management system.With the rapid improvement of China’s economic development level,facing the requirements of market economy development,such as complexity,diversification,specialization and high standardization,it also reflects the weakness of the existing management system,operation mechanism,personnel system and salary incentive system of China’s development zones,In particular,the management organization and operation mode of the development zone can not better adapt to the new needs of further deepening the reform and opening up.Through normative analysis and empirical analysis,this paper compares the governance modes of domestic and foreign development zone management organizations,analyzes the applicable environment of legal organizations,studies the governance structure and function setting,positioning and marketoriented operation mechanism of legal organizations,and explores and analyzes the nature and development trend of legal organizations in development zones,So as to study the innovation and application of the governance mode of the legal institutions in the future development zones in China.The article is divided into four partsThe first part is an overview of the Development Zone legal organization mode.First of all,it defines and classifies the development zones from various aspects and angles.In the process of development,especially in the second stage of Development Zone,China’s development zone has entered a period of rapid development,and various types of development zones have emerged,which has made great contributions to China’s economic development,but also brought many challenges to the management of development zones.Secondly,it analyzes the historical development of the development zone.On the one hand,it lists the whole process of the development of the development zones in China from the establishment to the present.On the other hand,it analyzes the development process of the development zones in western developed countries from the origin of the development zones.The second part is the comparative analysis of the governance mode of the legal institutions in the development zone.First of all,the definition of Development Zone legal institutions and the definition of legal institutions.Secondly,it makes a comparative analysis on the management mode of domestic development zone legal institutions,domestic and foreign development zone legal institutions,and analyzes the suitable conditions for the governance mode of domestic development zone legal institutions.Thirdly,from the new era,the development of new industries needs new institutional supply to elaborate the necessity of China’s Development Zone legal institutional governance model.The growth of traditional industrial economy is weak,and the new industry with innovation and high-quality development is irreversible“ The traditional management mode of "administrative guidance,centralized management and unified operation" has gradually been unable to adapt to the changes of new technology,new format,new industry and new mode,which is not conducive to the free flow and efficient allocation of elements and restricts the further development of the development zone.The third part is the analysis of the problems existing in the implementation process of the Development Zone legal institutional governance model.First of all,there is a lack of unified legal norms in the current governance model of the legal institutions in the Development Zone,which is mainly dominated by policy.The local legislative resources are scattered,there is no legislative authorization or legislative content authorization is not comprehensive,and there is no actual implementation.It is difficult for the local legislation of development zones to meet the needs of economic development and adapt to the requirements of China’s legal process.Secondly,the establishment or authorization of legal institutions in the development zone is not standardized.At present,there are no unified legal regulations on the basis,standard,power,responsibility and nature of the legal institutions of the development zone.Thirdly,in the process of the reform of the legal institutions of the Development Zone,the relationship between the legal institutions of the development zone and the local government has not been properly dealt with.It is not that the government is too strict in management,which leads to low efficiency and poor flexibility and can not meet the needs of rapid economic development;That is to say,it is divorced from the government,leading to market chaos,unclear nature and lack of clear development direction.Therefore,the reform of legal institutions in development zones should be market-oriented and legal.We should formulate unified laws and regulations for national development zones to provide legal guarantee for China’s rapid economic development in the next step.The fourth part is the improvement of the governance mode of the legal institutions in the development zones.This part mainly aims at the problems existing in the reform process of the legal institutions of development zones in China and puts forward some suggestions for improvement.First of all,in view of the lack of national unified legal norms in the development zones,the author suggests that in accordance with the needs of ruling the country by law and legalizing the country,we must reorganize and classify the development zones in our country,formulate unified legal norms of national development zones,make it clear that the legal institutions in the development zones have independent legal personality,so that the establishment,standard and operation of the legal institutions have legal basis.The reform of legal institutions in development zones should be in line with the direction of the reform of national Ministry System and public institutions.Secondly,the legal institutions of development zones should set up staff system,carry out marketoriented and enterprise oriented operation,reduce government interference,and carry out performance appraisal and survival of the fittest.The traditional pattern of "fixed rice bowl" or "income guaranteed by drought and flood" should be completely broken.In addition,we should improve the supervision system.Strengthen internal supervision,external supervision,dynamic whole process supervision and other mechanisms.China’s development zones,whether in the past or in the future,will play an important role in China’s economic development and remain an important engine of China’s economic development.The management mode of the development zone has experienced from the traditional government led mode to the mixed mode,and then to the legal organization mode of enterprise operation.With the development of economy and the change of society,the modernization of China’s micro management or macro national governance system needs to study the legal institutions of development zones.This research will be a major series of projects,never-ending.The advanced governance model of legal institutions in development zones is helpful to accelerate the reform and development of China’s administrative system and functional zones,and to accelerate the process of legalization in China.
