At the beginning of 2020,a sudden outbreak of new coronavirus swept the world,bringing an unprecedented disaster to all mankind.Under the strong leadership of the CPC Central Committee,the people of the whole country are united and determined to win the battle against epidemic prevention and control,and have achieved the basic victory in the fight against the epidemic,highlighting the advantages of China’s governance capacity and governance system.Compared with the SARS outbreak in2003,the new crown outbreak is more contagious,more destructive and has a deeper negative impact,but our country and people have weathered the outbreak and done better than most developed countries in the world.But the result of the basic victory does not mean that we do not need to reflect and sum up,grasp the short board,plug loopholes,strengths and weaknesses is the work that must be done and done all the time.First of all,this paper provides an overview of the definition of state of emergency and emergency law,and defines the conceptual framework of state of emergency and emergency law.Secondly.This paper expounds the current legal system of state of emergency and the legal system of emergency outside the domain of our country,and compares the two horizontally to find out the same points and differences.Thirdly,through the exposition and comparison of china’s legal system of state of emergency and the legal system of extraterriterial state of emergency,this paper analyzes the short board of the current legal system of state of emergency in china in the legislative and law enforcement links.Finally,in view of the above-mentioned short board,especially for the protection of civil rights,put forward some of the author’s simple views and suggestions,with a view to china’s emergency legal system can make a thin contribution.
